These Terms of Use ("Terms") govern your access to and use of the Kaloriq mobile and web application ("the App"). By creating an account or otherwise using the App, you agree to be bound by these Terms. If you do not agree to them, please do not use the App.

You must be at least 18 years of age to use the App. By creating an account you confirm that you meet this requirement. The App records health related information and is not intended for children.

You may hold only one account.

The App is a fitness and nutrition tracking tool. It is not a medical device and it does not provide medical advice, diagnosis or treatment. Workout plans, calorie targets and macronutrient splits are general estimates calculated from the information you supply. They are not prescribed by a qualified professional who has assessed you.

Consult a physician before beginning any exercise or diet programme. This is particularly important if you are pregnant, or if you have a heart condition, an existing injury, an eating disorder, diabetes, high blood pressure, or are taking prescribed medication.

Discontinue exercise and seek medical attention if you experience chest pain, dizziness, faintness, or pain beyond normal muscular effort. You exercise at your own risk and are responsible for selecting loads and movements appropriate to your ability.

Nutritional values produced by the food scanner are estimates generated by automated image analysis and may be inaccurate. Do not rely on them for any purpose where accuracy is medically important, including carbohydrate counting for insulin dosing.

Registration requires a valid email address. We send a verification code to that address to confirm that it belongs to you. Verification codes expire ten minutes after they are issued.

After five consecutive failed sign in attempts, the account is temporarily locked. Once signed in, you remain signed in for seven days, after which you must sign in again.

You are responsible for keeping your password confidential. Activity carried out through your account will be treated as your own.

The App is provided free of charge, on an "as is" and "as available" basis. We do not warrant that it will be available without interruption or free from errors. Features may be added, modified or withdrawn at any time.

You should not rely on the App as the sole record of any information that is important to you.

You agree not to access or attempt to access another user's account; copy, scrape or extract data from the service by automated means; interfere with or place unreasonable load on our infrastructure; reverse engineer any part of the App; or use the App for any unlawful purpose.

We may suspend or terminate any account used in breach of this clause.

You retain ownership of the information you enter, including workouts, meals, measurements and photographs. You grant us a limited licence to store and process that information solely for the purpose of operating the App for you, as described in our Privacy Policy.

All rights in the App itself, including its name, design, text and software, remain our property.

To the maximum extent permitted by law, we shall not be liable for any injury, loss or damage arising from your use of the App, from reliance on any estimate or recommendation it produces, or from the unavailability or loss of data.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

You may delete your account at any time from the Settings screen. Deletion is immediate and permanent, and is described further in our Privacy Policy.

We may suspend or terminate your account if you breach these Terms.

We may amend these Terms from time to time. Where an amendment is material, we will give notice within the App. Your continued use of the App after such notice constitutes acceptance of the amended Terms.

These Terms are governed by the laws of India. The courts of India shall have exclusive jurisdiction over any dispute arising out of or in connection with them.
